Service Agreement

This Service Agreement (“Agreement”) is entered into by and between CustomDesignCircle (“Service Provider,” “we,” “us,” or “our”) and the client (“Client,” “you,” or “your”).

By purchasing, approving, or engaging our services, you agree to be bound by the terms outlined below.

1. Services Provided

CustomDesignCircle provides custom digital design services, including but not limited to:

  • Logo design & brand identity

  • Custom website design & development

  • Website redesign & UI/UX design

  • Graphic design (banners, posters, marketing materials)

  • Social media graphics & profile design

  • Other creative design services as agreed

All services are custom-made and delivered digitally.

2. Project Scope

  • The scope of work, deliverables, timelines, pricing, and number of revisions will be discussed and agreed upon before work begins.

  • Any work requested outside the agreed scope will require additional fees and timeline adjustments.

  • Changes requested after approval may be treated as a new project.

3. Client Responsibilities

The Client agrees to:

  • Provide accurate information, content, and materials needed to complete the project

  • Respond promptly to feedback, approvals, and revision requests

  • Ensure all provided materials do not infringe on third-party rights

Delays caused by late responses or missing information may affect delivery timelines and do not qualify for refunds.

4. Payments & Fees

  • All prices are agreed upon prior to project commencement.

  • Full or partial payment may be required upfront.

  • All payments are non-refundable once work has started, due to the custom nature of services.

  • Deposits and upfront payments are non-refundable.

  • Failure to make timely payments may result in project suspension or termination.

5. Refund & Cancellation Policy

  • If a project is canceled before work begins, a refund may be issued at our discretion, minus any processing fees.

  • No refunds will be issued once work has started.

  • If canceled after work begins, the Client may receive completed work up to that point, where applicable.

This policy aligns with PayPal and Stripe guidelines for custom services.

6. Revisions

  • Each project includes a limited number of revisions, as agreed prior to starting.

  • Revisions must remain within the original scope of work.

  • Additional revisions or scope changes may incur extra charges.

  • Revisions are offered in place of refunds.

7. Project Approval & Completion

  • Client approval of final deliverables confirms project completion.

  • Once approved, the project is considered fulfilled and closed.

  • Any additional changes after approval will be billed separately.

8. Intellectual Property Rights

  • Upon full payment, ownership of the final approved design is transferred to the Client.

  • CustomDesignCircle retains the right to display completed work in portfolios, websites, and marketing materials unless the Client requests otherwise in writing.

  • All unused concepts, drafts, or preliminary designs remain the property of CustomDesignCircle.

9. Proof of Service & Communication

  • All communication, drafts, previews, revisions, and final files serve as proof of service delivery.

  • These records may be used as evidence in the event of a payment dispute or chargeback.

10. Chargebacks & Disputes

  • The Client agrees to contact CustomDesignCircle first to attempt resolution before initiating a PayPal or Stripe dispute.

  • Unauthorized or false chargebacks may result in immediate service termination.

  • We reserve the right to submit all service records and communication logs as evidence to payment processors.

11. Limitation of Liability

CustomDesignCircle shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of revenue, business, or data

  • Third-party platform issues (hosting, domains, plugins, payment processors)

Our total liability is limited to the amount paid for the service.

12. Confidentiality

Any confidential information shared during the project will be kept private and used only for project completion, unless disclosure is required by law.

13. Termination

We reserve the right to terminate services for:

  • Non-payment

  • Breach of this Agreement

  • Abusive or inappropriate communication

  • Lack of cooperation or extended inactivity

No refunds will be issued for terminated projects with work already completed.

14. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, United States.

15. Acceptance of Agreement

By making a payment, approving a proposal, or engaging our services, you acknowledge that you have read, understood, and agreed to this Service Agreement.
